Vancouver Island town will fight BC Supreme Court decision to review a controversial development

The Municipality of North Cowichan, on Vancouver Island,  has decided to appeal a BC Supreme Court ruling that ordered it to reconsider a racetrack proposal.  Vancouver Island Motorsports Circuit forced the judicial review after council turned down its proposal to build a second track, on a property adjacent to the one it currently operates.  It argued council's decision was arbitrary and without explanation.  The Supreme Court agreed.  It ordered the municipality to reconsider the company's development permit application.  North Cowichan Mayor Al Siebring says council does not want to do that.  Siebring would not discuss the legal argument the municipality plans to use in its appeal.  He will only say the issue continues to divide the community.

 

 

Siebring expects the debate will die down as the community waits for another court decision, but he expects it will ramp up again, when the BC Court of Appeal makes its ruling.  No date has been set for the appeal hearing.
