{"id":75783,"date":"2022-01-04T13:30:36","date_gmt":"2022-01-04T18:30:36","guid":{"rendered":"https:\/\/canada-info.ca\/?p=75783"},"modified":"2022-01-05T16:40:10","modified_gmt":"2022-01-05T21:40:10","slug":"feeder-pipeline-posed-to-pass-through-nisgaa-territory","status":"publish","type":"post","link":"https:\/\/canada-info.ca\/en\/feeder-pipeline-posed-to-pass-through-nisgaa-territory\/","title":{"rendered":"Feeder Pipeline posed to pass through Nisga&#8217;a territory"},"content":{"rendered":"<p>A potential pipeline that would supply liquefied natural gas to the proposed\u00a0<a href=\"https:\/\/www.theskeena.com\/2021\/07\/25\/we-expect-controversy-nisgaa-nation-proposes-10b-gas-facility-north-of-rupert\/\" target=\"_blank\" rel=\"noopener\">Ksi Lisims LNG facility<\/a>\u00a0near the mouth of the Nass River could be ruled invalid by the Canadian Energy Regulator.<\/p>\n<p>According to a Canadian Energy Regulator application filed by\u00a0<a href=\"https:\/\/www.linkedin.com\/in\/mike-sawyer-56357b46?originalSubdomain=ca\" target=\"_blank\" rel=\"noopener\">Mike Sawyer, Executive Director for the Citizen\u2019s Oil and Gas Council<\/a>, \u201cthe PRGT Project and North Montney Pipeline, along with Nova Gas\u2019 interprovincial system, together comprise a single federally-regulated undertaking, and as such the PRGT Project falls within federal, not provincial, jurisdiction and is subject to regulation by the CER. I respectfully request that the CER issue a declaratory order and a Notice of Constitutional Question as requested.\u201d<\/p>\n<p>In 2014, Sawyer questioned the jurisdiction of the <a href=\"https:\/\/www.tcenergy.com\/operations\/natural-gas\/prince-rupert-gas-transmission-project\/\" target=\"_blank\" rel=\"noreferrer noopener\">Prince Rupert Gas Transmission<\/a>, arguing to the National Energy Board at the time, now the Canadian Energy Regulator, that the pipeline was incorrectly assessed and should be regulated under federal jurisdiction, not provincial. A federal appeals court\u00a0<a href=\"https:\/\/thenarwhal.ca\/legal-challenge-stall-lng-canada\/\" target=\"_blank\" rel=\"noopener\">seemed to side with Sawyer<\/a>\u00a0before Petronas cancelled the project.<\/p>\n<p>In September 2021, the <a href=\"https:\/\/www.nisgaanation.ca\/\" target=\"_blank\" rel=\"noreferrer noopener\">Nisga\u2019a Lisims Government<\/a>\u00a0in the Nass Valley\u00a0<a href=\"https:\/\/www.theskeena.com\/2021\/07\/25\/we-expect-controversy-nisgaa-nation-proposes-10b-gas-facility-north-of-rupert\/\" target=\"_blank\" rel=\"noopener\">announced<\/a>\u00a0an ambitious new resource project, Ksi Lisims (s\u2019lisims) LNG, a 12-million-tonne-per-year liquefied natural gas (LNG) project at Wil Milit, north of Prince Rupert, BC near the Nisga\u2019a village of Gingolx.<\/p>\n<p>The project will be managed equally by the Nisga\u2019a Nation,\u00a0<a href=\"http:\/\/rockieslng.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rockies LNG<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.westernlng.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Western LNG<\/a>.<\/p>\n<p>The location of the new LNG project is slated for the Wil Milit, approximately 15 kilometers east of Gingolx, on treatied land.
