{"id":33673,"date":"2021-01-13T11:20:33","date_gmt":"2021-01-13T16:20:33","guid":{"rendered":"https:\/\/canada-info.ca\/?p=33673"},"modified":"2021-01-20T11:32:48","modified_gmt":"2021-01-20T16:32:48","slug":"derrick-dixon-doesnt-quite-get-his-day-in-court-after-covid-infraction-ticket-not-submitted","status":"publish","type":"post","link":"https:\/\/canada-info.ca\/en\/derrick-dixon-doesnt-quite-get-his-day-in-court-after-covid-infraction-ticket-not-submitted\/","title":{"rendered":"Derrick Dixon doesn\u2019t quite get his day in court, after COVID infraction ticket not submitted"},"content":{"rendered":"<p>Last Tuesday, Derrick Dixon, owner of Hounds of Vintage clothing shop on York Street in Sackville, got in a borrowed car and made the trip to the closest provincial courthouse in Moncton.<\/p>\n<p>Dixon was showing up to contest a ticket he had received six weeks before, from RCMP Constable Christophe Bertrand, for non-compliance with the Emergency Measures Act. It\u2019s a ticket that Dixon feels was unfairly given, after he commented to the officers that he felt their presence was \u201ca bit much\u201d and potentially anxiety-inducing.<\/p>\n<p>Dixon got to the courthouse before his assigned time, and waited for about an hour outside the courtroom. By the time he was called in, he was told he didn\u2019t need to be there.<\/p>\n<p><em><strong>Hear Derrick Dixon tell his story on Tantramar Report:<\/strong><\/em><\/p>\n<!--[if lt IE 9]><script>document.createElement('audio');<\/script><![endif]-->\n<audio class=\"wp-audio-shortcode\" id=\"audio-33673-1\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/canada-info.ca\/wp-content\/uploads\/2021\/01\/Derrick-Dixon-Jan-8-2021-1.mp3?_=1\" \/><a href=\"https:\/\/canada-info.ca\/wp-content\/uploads\/2021\/01\/Derrick-Dixon-Jan-8-2021-1.mp3\">https:\/\/canada-info.ca\/wp-content\/uploads\/2021\/01\/Derrick-Dixon-Jan-8-2021-1.mp3<\/a><\/audio>\n<p>\u201cI was in there for about 30 seconds,\u201d says Dixon. \u201cAnd they said that the ticket hadn\u2019t been laid, which I guess means it wasn\u2019t submitted. I was free to go.\u201d<\/p>\n<p>If you think Dixon\u2019s first reaction was relief, you\u2019d be mistaken. Frustration is more like it.<\/p>\n<p>Dixon had gone to Moncton after weeks of worry and planning in order to formally contest the ticket which he believes was issued for the wrong reasons.<\/p>\n<p>\u201cI was really hoping to sort of have a record of how I felt about the whole incident,\u201d says Dixon. \u201cBut now it\u2019s kind of like it doesn\u2019t even exist.\u201d<\/p>\n<p>\u201cObviously the ticket wasn\u2019t given for any legitimate reason if it didn\u2019t even make it that far,\u201d says Dixon. \u201cSo yeah, I\u2019m feeling pretty frustrated right now.\u201d<\/p>\n<p>Dixon was issued the ticket in November after two officers visited his store for a compliance check. At first, the officers issued a compliance order to Dixon, for not having a copy of his operational plan behind his counter. The compliance order gave Dixon 24 hours to correct his mistake, which he told CHMA at the time was \u201ctotally fine.\u201d<\/p>\n<p>\u201cI think that it\u2019s good that the protocols are being monitored,\u201d he told CHMA in November.<\/p>\n<p>But then, when Dixon commented on the fact that the officers visit was \u201ca bit much\u201d and\u00a0possibly \u201canxiety-inducing for people,\u201d one of the officers asked him for his ID and proceeded to write him a ticket.<\/p>\n<p>The ticket, which Dixon posted on social media, is for non-compliance with the Emergency Measures Act, and comes with a fine of $292.50. After considering his options and consulting others, Dixon decided he would not pay the ticket, but would contest it in court.<\/p>\n<p>\u201cI felt pretty confident based on all the conversations I\u2019ve had with people that the ticket was would get thrown out,\u201d says Dixon, which adds to his frustration in not getting his day in court.<\/p>\n<p>Dixon says the RCMP didn\u2019t inform him that the ticket wasn\u2019t submitted, and that they also haven\u2019t been back to his shop to check on the compliance order they issued at the same time as the ticket, back on November 24, 2020.<\/p>\n<p>With some help from MLA Megan Mitton\u2019s office, Dixon has a list of people to call to inform them of what happened. \u201cI do want there to be a record of this,\u201d says Dixon. \u201cBecause clearly, they gave me a ticket for a reason that has nothing to do with safety. And I think that there just needs to be some accountability there.\u201d<\/p>\n<p>Dixon says he, \u201ccan think of a few reasons why,\u201d he was issued the ticket.<\/p>\n<p>\u201cI can\u2019t not think about the fact that a few days before this incident the report came out saying that the RCMP harbours an environment of racism, homophobia and misogyny,\u201d says Dixon.<\/p>\n<p>He\u2019s referring to\u00a0<a href=\"https:\/\/www.rcmp-grc.gc.ca\/en\/final-report-implementation-merlo-davidson-settlement-agreement\" target=\"_blank\" rel=\"noreferrer noopener\">a report by former Supreme Court justice Michel Bastarache<\/a>\u00a0which came out November 19, 2020. In the report, Bastarache wrote that, \u201ca toxic culture prevails in the RCMP. This culture encourages, or at least tolerates, misogynistic, racist and homophobic attitudes among many members of the RCMP.\u201d<\/p>\n<p>\u201cFor them to give me a ticket in a space that\u2019s very, boldly queer,\u201d says Dixon, \u201cI don\u2019t know.\u201d<\/p>\n<p>\u201cStatistically and historically, queer people are over policed by the RCMP,\u201d says Dixon. \u201cSo that doesn\u2019t sit very well with me, even though it\u2019s a really hard thing to prove. But it\u2019s definitely something that I feel in my gut.\u201d<\/p>\n<p>\u201cThe underlying status quo of my life is people who are not queer, interacting with me differently than they will with other people,\u201d says Dixon.<\/p>\n<p>Dixon is hoping that by documenting his experience and telling people about it, there\u2019s a chance that someone might learn from it.<\/p>\n<p>\u201cIf I put this complaint forward, the most that I can hope for is that someone who reads this along the line will just take a minute to reflect on that, and their own interactions with other people,\u201d says Dixon.<\/p>\n<p>Dixon says he appreciates the support he received from community members in response to the incident.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Last Tuesday, Derrick Dixon, owner of Hounds of Vintage clothing shop on York Street in Sackville, got in a borrowed car and made the trip to the closest provincial courthouse in Moncton.
